1. Agreement to Terms

By accessing or using PulseBook.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

PulseBook.io is an AI-powered platform for creating illustrated books. The Service allows you to create characters, locations, and scenes, generate AI illustrations, and design book pages. We use Google's Gemini AI models to generate images based on your descriptions and reference materials.

3. Account Terms

• You must be at least 13 years old to use this Service
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• One person per account - account sharing is not permitted
• You must notify us immediately of any unauthorized use of your account

4. Subscriptions and Payments

4.1 Credit System

• Credits are used for AI image generation
• Different operations consume different amounts of credits
• Credits do not expire while you have an active subscription
• Unused credits are subject to rollover limits based on your subscription tier

4.2 Subscription Plans

• Subscriptions are billed monthly or yearly through Stripe
• Subscriptions auto-renew unless cancelled before the renewal date
• Downgrades take effect at the end of the current billing period
• Upgrades take effect immediately with prorated billing

4.3 BYOK (Bring Your Own Key) Plan

• You may use your own Google AI API key
• You are responsible for all API costs charged by Google
• Platform fee of $14.99/month applies
• Your API key is encrypted and stored securely

4.4 Refunds

Refunds are handled on a case-by-case basis at our discretion. To request a refund, please contact us at [email protected].

5. Content Ownership and License

5.1 Your Content

You retain ownership of:

• Books, text, and descriptions you create
• Character and location designs you describe
• Images and files you upload

5.2 License to Us

By using the Service, you grant us a worldwide, non-exclusive license to process, store, and display your content as necessary to provide the Service. This includes sending your content to third-party AI services for generation purposes.

5.3 Generated Images

• You own the images generated through your use of the Service
• Generated images are subject to Google's Gemini usage policies
• You may use generated images for commercial purposes
• We do not use your content or generated images for marketing purposes

6. AI-Generated Content Disclaimer

• AI-generated content may be imperfect, unexpected, or require refinement
• We do not guarantee specific results or outcomes
• You are responsible for reviewing all generated content before use
• Despite safety measures, AI may occasionally produce inappropriate content
• Each generation consumes credits regardless of the result quality

7. Acceptable Use Policy

You agree NOT to use the Service to:

• Create illegal, harmful, or abusive content
• Generate content depicting minors inappropriately
• Create harassment, hate speech, or discriminatory content
• Infringe on others' copyrights, trademarks, or intellectual property
• Attempt to bypass the credit system or obtain free generations
• Reverse engineer, decompile, or attempt to extract the underlying AI models
• Use automated systems or bots without our explicit permission
• Share account credentials or allow unauthorized access
• Resell or sublicense access to the Service

8. Intellectual Property

The Service, including its design, features, and functionality, is owned by PulseBook.io and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without permission.

9. Service Availability

• We strive for high availability but do not guarantee 100% uptime
• The Service may be temporarily unavailable for maintenance or updates
• We may modify or discontinue features with reasonable notice
• We are not liable for any losses due to service interruptions

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of data, profits, or business opportunities

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the minimum extent permitted by law.

11. Termination

• You may cancel your subscription at any time through your account settings or by contacting support
• We may suspend or terminate your account for violations of these Terms
• Upon termination, your access to the Service ends immediately
• We may delete your data 30 days after account termination
• Provisions that by their nature should survive termination will remain in effect

12. Governing Law

These Terms are governed by the laws of Poland and the European Union. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Poland, without prejudice to any mandatory consumer protection rights in your jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
